Services & Payments

​

• All prices are listed in euros (€).

• A retainer fee of 75% or full payment is required before any work begins.

• If a client fails to communicate for 5 consecutive days, a startup fee will be required to resume the project.

• The intellectual property (IP) provided by the client remains theirs, but all designs and deliverables remain the property of The Désirée Effect until full payment is received.

• Once fully paid, clients have the right to use all designs, provided they do not claim to have created or designed them.

• Branding materials included in their package may not be resold or claimed as their own.

 

Project Timelines & Delivery

• Service completion timelines range from 4 to 12 weeks, depending on the package, revisions, deliverables, and communication response times.

• Any delays caused by the client (e.g., late responses, lack of required materials) may result in an extended timeline.

 

Intellectual Property & Usage Restrictions

• All content, designs, and branding materials created by The Désirée Effect remain our intellectual property until full payment is received.

• Clients may only use final deliverables for their own business purposes and may not resell, redistribute, or modify them without permission.

• Unauthorized use of our branding materials, website content, or images is strictly prohibited. If you wish to use any of our images for promotional purposes, written permission is required.

 

Dispute Resolution & Governing Law

• These Terms & Conditions are governed by the laws of France/Saint Martin.

• In the event of a dispute, both parties agree to attempt mediation or arbitration before pursuing legal action.

 

Changes to These Terms

 

The Désirée Effect reserves the right to update or modify these Terms & Conditions at any time, without warning. Continued use of our website and services constitutes acceptance of any revisions.
